In a city gasping for breath, felling of trees should be last resort: Delhi High Court

Observing that felling of trees should be the last resort in the national capital, Delhi High Court recently restrained Delhi Development Authority (DDA) and others from “clearing of land and felling of trees” on a plot in South Delhi’s Vasant Kunj.

In a June 14 order, a single-judge bench of Justice Jasmeet Singh observed, “My attention has been drawn to photographs which show that the plot of land has become a biodiversity park with beautiful trees, wildlife, birds, etc. In a city gasping for breath, I am of the view that felling of trees should be the last resort. In case any other alternative site is available, the same must be looked at.”

The order was passed in a plea moved by the All Residents Welfare Society, which sought to restrain Caelum Arpit Brand Technologies Private Limited, the DDA and others “from going ahead with the proposed complex”.

Construction of the complex required clearing of land, felling of trees and carrying out construction on the plot in Sector A Pockets B&C, Vasant Kunj.

The plea also prayed that the proposed complex be shifted to an alternative plot suitable for the purpose.

“For the said reasons, till the next date of hearing, the respondents are restrained from clearing of land and felling of trees on the plot comprised in Sector A Pockets B&C, Vasant Kunj, New Delhi,” Justice Singh ordered and listed the matter before the roster bench on July 3.
